Our website address www.cattlemansbrewingco.com.au is owned by Cattleman’s Brewing Co Pty Ltd (“Cattleman’s Brewing Co”), registered March 2021 (ABN 45 647 220 362/ ACN 647 220 362) by continuing to use our website, you are agreeing to comply with the following terms and conditions. If you do not agree with our terms and conditions, please feel free to use another website.

This website is operated by Cattleman’s Brewing Co. The terms “us”, “our” and “we” refer to Cattleman’s Brewing Co. The services available from this site, to you, the user, are conditional upon your acceptance of all the terms, conditions and policies stated here. By visiting our website and/or purchasing from us, you engage in our service and agree to be bound by the following terms and conditions. Please read these terms and conditions carefully before accessing or using this website. 

Our service includes our products offered for supply, information provided by us to you, our website and online store and all terms and conditions contained within our website.  The headings used in this agreement do not limit or otherwise affect these terms and conditions.

Terms and Conditions 

1. Website 

1.1- We may update and change the content of this website from time to time. Please familiarise yourself with these terms and conditions each time you visit this website as our terms and conditions may change from time to time. 

1.2 - To gain access to our website, you must be over the age of 18 years. Dishonesty regarding legal age is against the law and further action will be enforced. You will be denied entry to our website and future purchases will be declined due to dishonesty. Cattleman’s Brewing Co adhere to the responsible service of alcohol and laws surrounding supply to underage customers. The Cattleman’s crew reserve the right to refuse entry to our site for those not meeting the legal drinking age.

1.3 - We reserve the right to refuse service to anyone for any reason, at any time.

1.4 - You understand and accept that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

1.5 - You agree not to reproduce, duplicate, copy, sell, re-sell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

2. User Comments, Feedback and Other Submissions 

2.1 - If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.  We shall be under no obligation (a) to maintain any comments in confidence; (b) to pay compensation for any comments; or (c) to respond to any comments.

2.2 - We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, racist, or otherwise objectionable or to violate any party’s intellectual property or these terms and conditions.

2.3 - You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of our service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party. 

3. Online store

3.1 - Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to terms and conditions relating to returns and refunds set out below.

3.2 - We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

3.3 - We reserve the right, but are not obligated, to limit the sales of our products or provision of services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

3.4 - We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in our service will be corrected.

3.5 - There may be times when our product is not in stock or not available in the quantities you might require and you may have to wait for restocking.  You will be notified before proceeding to checkout if stock or stock in the quantities you require is or is not available.

3.6 - Promotional Codes & Offers

3.6.1 - Our promotional codes are only valid at the time of purchase and cannot be redeemed after you have purchased an item. Please also note that some promotional offers will be deactivated at sale times as these cannot be used in conjunction with any other offer 

3.6.2 - You are most welcome to redeem your other promotional offer once the sale is over and the previous offers have been reactivated. Only one promotional code can be applied to a single order.

3.7 - Email Newsletter Sign Up Offer

3.7.1 - Use the unique code from your welcome email to receive 10% of your first purchase. 

3.7.2 - This discount cannot be used in conjunction with any other promotional offers and cannot be applied to any previous or future purchases.

3.7.3 - This offer can only be used once per customer, on their first order only.

3.7.4 - This offer may be deactivated during sale periods.

3.7.5 - Cattleman's Brewing Co reserves the right to amend the details of this promotion at any time.

4. Cattleman’s Merchandise Shop

4.1 - There may be times when merchandise is unavailable in stock or your size and you may have to wait for restocking. 

4.2 - You will be notified before proceeding to checkout if stock or stock in your size is or is not available. 

4.3 - When you are successful with purchase, a conformation email will be sent. If for any reason there is a delay with your purchase, you will be notified of the delay.

5. Payment 

5.1 - We accept the following methods of payment:

(a) Paypal

(b) Credit or debit card (MasterCard, Visa, American Express).

5.2 - You confirm that the credit card or debit card payment used by you is your card or you have been expressly authorised by the owner of the card used to make a purchase in our store. 

5.3 - We will not be responsible for any delay in despatch or supply of your goods in circumstances where the issuer of the card or owner of the card does not authorise the payment/debit from the relevant card.

5.4 - You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

6. Shipping and delivery

6.1 - We want to make sure your order arrives safely, therefore someone will need to be home to accept the order. 

6.2 - We reserve the right to refuse delivery or to leave the products at your nominated place if someone is not home who is of the age of majority.

6.3 - We may require you provide currently accepted proof of age documentation at the time of delivery. 

6.4 - In the event that someone is not home, your order will be re-directed to either your nearest Australia Post office or re-delivered by our courier service if organised and paid for by you.

6.5 - Once you receive an order confirmation via email, we will use best endeavours to process your order within 2-3 business days (this excludes weekends and public holidays).

6.6 - You will receive an email notification once your order has been shipped. You can use the tracking details to check it's status. Please allow up to 48 hours for tracking information to be available.

6.7 - Delivery times are estimated between 3-10 business days and we will use best endeavours to deliver within this time frame.

6.8 - Please note that delays in our third party delivery times are subject to change and environmental factors such delayed Australia Post delivery times being experienced whilst the New South Wales Public Health Order responding to COVID 19 is in place. 

6.9 - You agree that risk of loss or damage to products relating to your order passes on delivery of the products to the address provided by you or otherwise if clause 6.4 applies and we will not responsible for any loss or damage which results from delivery of products made in accordance with your instructions or in accordance with clause 6.4.

6.10 - If for any reason you require further information about your order, please email admin@cattlemansbrewingco.com.au

7. Returns, refunds and faulty or damaged products

7.1 - If you receive a package which is visibly damaged or opened, please insist that this be noted with the courier before signing for your order.

7.2 - In the unlikely situation that you receive faulty or damaged items, please advise our crew in writing, by email to admin@cattlemansbrewingco.com.au as soon as possible after you receive the goods which will be the day the courier confirms delivery. 

7.3 - We will require your order number and a clear photo of the item's condition. Please note that any damages are assessed on a case by case basis. Cattleman's Brewing Co reserves the right to determine whether the items are faulty or damaged.

7.4 - Shipping costs are non-refundable. We may seek reimbursement for any costs incurred by us if the items are found to be ok.

7.5 - We are strictly unable to refund SALE items subject to 7.1 to 7.4 above. This also includes promotional discounts and all discount codes.

7.6 - If you have simply changed your mind, we will accept returns up to 7 days after delivery, only if the items are unopened, unused and in original condition. Your order will be refunded minus any shipping costs, and minus any shipping costs for the return.

8. Privacy 

Your submission of personal information through our website is governed by our privacy policy. Please read our privacy policy carefully. Our privacy policy may change from time to time and as our company evolves. 

9. Self Exclusion

9.1 - The health and wellbeing of customers is first and foremost to our crew and we promote the responsible consumption of alcohol. 

9.2 - If you wish to exclude yourself from our services including purchasing, promotional materials or communications you are able to do this by contacting our crew via the email admin@cattlemansbrewingco.com.au. 

10. Legal Notice 

10.1 - Cattleman’s Brewing Co support the responsible service of alcohol in accordance with the laws of applicable states and territories.

10.2 - Our products and services are not intended for use by minors and are supplied under Liquor Licence number LIQP770017657 

10.3 - No Alcohol can be sold or supplied to anyone under 18. It’s against the law.

10.4 - Secondary supply. If we believe that you are purchasing our products with the intention of secondary supply we may refuse to supply you with a product and or service. 

10.5 - NSW Liquor Act 2007- It is an offence to supply liquor to a person under the age of 18 years.

10.6 - QLD Liquor Act 1992- A person must not falsely represent himself or herself to have attained 18 years for a wrongful purpose. A person must not supply or permit or allow liquor to be supplied to a person under the age of 18 years.

10.7 - VIC Liquor Control Reform Act 1998- It is an offence to supply or permit liquor to be supplied to a person under 18 years.

10.8 - ACT Liquor Act 2010- it is illegal to sell alcohol to a person under the age of 18 years.

11. Prohibited Uses

11.1 - In addition to other prohibitions as set forth in these terms you are prohibited from using the site or its content:  a) for any unlawful purpose; b) to solicit others to perform or participate in any unlawful acts; c) to submit false or misleading information; d) to collect or track the personal information of others.

11.2 - We reserve the right to terminate your use of our service for violating any of the prohibited uses.

12. Errors, inaccuracies and omissions

12.1 - Occasionally there may be information on our site or in our service that contains typographical errors, inaccuracies or missions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.  We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

12.2 - We undertake no obligation to update, amend or clarify information including pricing information, except as required by law.

13. Disclaimer of warranties; limitation of liability

13.1 - We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

13.2 - We do not warrant that the results that may be obtained from the use of our service will be accurate or reliable.

13.3 - You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.  You expressly agree that your use of, or inability to use, the service is at your sole risk.  The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘a available’ for your use, without any representation, warranties or conditions of any kind to the maximum extent permitted by law.

14. Indemnification

14.1 - You agree to indemnify Cattleman’s Brewing Co and its directors, agents, contractors and employees from any claim or demand made by any third party due to or arising out of your breach of these terms or your violation of any law or the rights of a third-party.

15. Termination generally

15.1 - If in our sole judgment you fail, or we suspect that you have failed, to comply with any of these terms, we may terminate this agreement at any time and you will remain liable for all amounts due up to and including the date of termination.

16. Entire agreement

16.1 - These terms and any policies or operating rules posted by us on this site constitutes the entire agreement and understanding between you and us and govern your use of our service.

17. Changes to terms of service

17.1 - You can review the most current version of our terms at any time at this page.

17.2 - We reserve the right, at our sole discretion, to change any part of these terms by posting changes to our website.  

17.3 - Your continued use of our website or our service following the posting of any changes to these terms constitutes acceptance of those changes.

18. Governing law

18.1 - These terms and any agreement whereby we provide you our services shall be governed by and construed in accordance with the laws of New South Wales, Australia which is deemed to be the place where our agreement with you is made.
